Learning outcomes of course unit | Remembering: basic norms of international law, in particular the provisions of Conventions and other UN, EU, CIS documents in the field of combating unlawful acts against the safety of navigation, which lead to material and non-material damage and loss of life; certain aspects of the regulatory and legal framework of Ukraine in the field of combating piracy and maritime terrorism on the basis of the valid legislation. Understanding: the essence of the concepts of "act of violence at sea", "piracy", "maritime terrorism" and the corpus delicti of these crimes; features of national legislation on combating piracy and maritime terrorism and compliance of this legislation with international legal principles and norms; features of ensuring maritime security from unlawful acts of violence, which is a set of legal, organizational, administrative, operational, security, military, technical and other measures aimed at preventing, detecting, preventing unlawful acts that create a risk of loss of life and other negative consequences at sea. Applying of Knowledge (Skills): to be able to correctly interpret and apply international legal norms and norms of national legislation during the investigation of crimes on board a ship; contribute to the implementation of the protection of sailors from piracy and maritime terrorism; to use international norms in the field of combating acts of violence committed in the waters of the World Ocean and their specificity to assess and analyze legal facts, legal situations, legal conflicts and ways of resolving them. Analyzing: the main theoretical approaches to the research of the concepts of "piracy" and "maritime terrorism", their characteristic features as a global problem of our time; emergence and evolution of the mechanism for combating piracy and maritime terrorism; legal mechanisms and instruments of international organizations for combating crimes in the maritime sector; international cooperation in combating piracy and maritime terrorism and prospects of its development; systems for ensuring the security of maritime spaces from illegal acts (legal, organizational, administrative, operational, security, military, technical, etc. aimed at prevention, detection. Prevention of unlawful acts). Evaluating: the importance of multilateral cooperation in combating acts of violence at sea in the modern conditions; application of a set of regulatory legal acts aimed at detailing the activities of executive authorities engaged in combating unlawful acts in the field of maritime navigation protection; the importance of legal, organizational, administrative, operational, security, military, technical and other measures aimed at preventing, detecting and deterring unlawful acts. Creating: draft legal acts on combating piracy and maritime terrorism and improving this legislation in line with international legal principles and norms. |
