Learning outcomes of course unit | Successful completion of the Maritime Law study programme provides for the acquisition of the following learning outcomes by the higher education student: Knowledge of: - legal regimes of maritime areas; legal support for maritime safety; - documents used in international maritime shipping (general declaration; cargo declaration; declaration of ship's supplies; declaration of personal belongings of the ship's crew; ship's role; passenger list; marine sanitary declaration), their content and purpose; special measures to simplify formalities related to the entry of ships into ports for the purpose of disembarking sick or injured crew members, passengers and other persons for emergency medical care; - international standards and the concept of the limits of responsibility of the competent authorities of the state, shipowner and ship officers in relation to maritime safety; - the content, essence and significance of the main international standards and acts of national legislation regulating labour and related relations arising in the field of merchant shipping; - IMO conventions on safety of life at sea and safety and protection of the marine environment, especially with regard to ship's documents and certificates issued by the competent authorities of the flag state of the ship; - conditions of carriage of cargo, passengers and baggage by sea; - measures for the protection of human life at sea, duties and responsibilities of ship's officers in applying SOLAS requirements. Understanding: - the duties and responsibilities of the ship's officers to fulfil international requirements for the safety of the ship, crew, passengers and cargo and to protect the sea from pollution from ships; - precautions to be taken to prevent pollution of the marine environment; - legal acts in the field of ensuring safety of navigation, protection of human life at sea, prevention of marine pollution, social protection of seafarers for assessment and analysis of legal facts, legal statuses, legal situations, legal conflicts and ways of their resolution. - types of inspection by an authorised official in the port of a Member State exercising state control in accordance with the ILO Maritime Labour Convention; - social and labour aspects of international labour law in the field of seafarers' labour and the activities of international organisations; - a correct understanding of the procedures to be followed during the rescue of people at sea; - the importance of measures to protect human life at sea, the duties and responsibilities of ship's officers in applying SOLAS requirements. Skills: - correctly interpret and apply international regulations on ship inspection by the competent authorities of the flag state, port state, based on international conventions; - draft letters and respond to supervisory authorities regarding maritime safety and prevention of marine pollution; - to apply the requirements of international labour standards regarding the conditions and time of watchkeeping, working hours and rest periods, filing complaints both on board and ashore, to promote the protection of seafarers' rights in the social and labour sphere and the implementation of the rule of law in any area related to ship operation; - analyse the current international and domestic legislation on maritime safety and marine environment protection; - to formulate goals and objectives, main functions and powers of state control authorities to ensure maritime safety, taking into account the specifics of the organisation and activities of each of these authorities; - give a general description of specific legal situations arising in the field of merchant shipping; - to perform professional duties related to the functions of: management of ship operations and care of people at the management level. Communication: - reporting of information, ideas, problems, solutions and own experience in the field of professional activity to specialists and non-specialists; - reporting of solutions and personal experience, referring to legal acts in the field of ensuring maritime safety, protection of human life at sea, prevention of marine pollution, social protection of seafarers, to assess and analyse legal facts, legal situations, legal conflicts and ways to resolve them. Autonomy and responsibility: - developing basic knowledge of ship operations management and taking care of people on board; - management of complex actions or projects, responsibility for decision-making in unforeseen conditions. |

Content of course unit | Topic 1: Introduction to the Maritime Law. Conferences on the maritime law. General description of the 1982 UN Convention on the Law of the Sea. Protection of the marine environment. Topic 2. Classification of maritime areas: concept and legal status of maritime areas with different statuses and regimes. Topic 3. Seagoing vessel as an object of legal relations. Registration of ships, national jurisdiction of the flag state, cases of removal from jurisdiction. Topic 4. Certificates and other ship documents in accordance with international conventions. Legal grounds and procedure for issuing the main ship's documents. Harmonisation of national legislation of Ukraine with international law. Topic 5. Content and purpose of the International Convention for the Safety of Life at Sea, 1974 (SOLAS). Topic 6. International Code for the Management of the Safe Operation of Ships and Pollution Prevention (ISM Code). Topic 7. International legal significance and general description of the International Convention on Cargo Marks, 1966 and the Convention on the Measurement of Ships, 1969. Topic 8: Detention and arrest of ships. Maritime protest: concept, significance, procedure of execution. Topic 9: General and private average: concept, signs, legal regulation. Topic 10. Legal regulation of protection of the marine environment from pollution (International Convention for the Prevention of Pollution from Ships (MARPOL73/78). Topic 11. International Convention for the Control and Management of Ships' Ballast Water and Sediments (BWM 2004). International Convention on the Control of Harmful Anti-fouling Systems on Ships (AFS 2001). Topic 12: Conventions and other international instruments relating to the carriage of passengers and their baggage by sea (SТР 1971, SРАСЕ SТР 1973, РАL 1974). Topic 13. Regulatory and legal regulation of Port State Control requirements. The International Ship and Port Facility Security Code (ISPS CODE 2002). Topic 14: ILO Maritime Labour Convention, 2006: general description and significance. Topic 15. The International Convention on Standards of Training, Certification and Watchkeeping for Seafarers (STCW), 1978, as amended by the Manila Amendments, 2010. Topic 16. Maritime assistance and rescue (SAR 79, LSC 89, LOF 2000, SCOPIC). Topic 17. International Convention on Intervention on the High Seas in the Case of Oil Pollution Accidents (1969), International Convention on Civil Liability for Oil Pollution at Sea (1969). |
