Learning outcomes of course unit

Remembering:

foundations and principles of international private maritime law;

conflict of law rules for the regulation of maritime legal relations complicated by a foreign element;

the main doctrines of the formation of institutions and branches of international private maritime law.

Understanding:

principles of legal regulation of private law relations in the field of merchant shipping, complicated by a foreign element;

the nature of charter party contracts;

essence of cargo, passengers and baggage transportation contracts;

the importance of the unification of legal norms for the regulation of private relations in commercial shipping, complicated by a foreign element.

Application of knowledge (skills):

interpretation of conventional norms regulating international private law relations in merchant shipping;

application of special methods and principles for regulation of private law relations in the field of merchant shipping, complicated by a foreign element;

classification of extraordinary marine events;

identification of property liability in international private maritime law.

Analyzing:

definition of the institution of general and separate (non-general) accidents in international private maritime law;

recognition of port and inter-port towing;

selection of types of charters;

separation of marine events and extraordinary marine events;

determining the grounds for releasing the carrier from liability.

Evaluating:

the role of international organizations in the unification of international private maritime law;

substantiation of the grounds for the application of conflict and material methods of regulating relations in international private maritime law;

substantiation of the role and importance of reservations and warranty letters during sea cargo shipping.

client consultation on the application of conflict of laws rules in the field of merchant shipping, resolution of the legal cases, etc.

Content of course unit

The concepts, sources, methods, subjects and objects of international private maritime law. The issue of unification of international private maritime law. The legal regulation of cargo and passenger maritime transportation. Ships chartering.  The port and the interport towing. Maritime liens and leasing of ships. Extraordinary marine events. Property liability in international private maritime law. Limitation of liability of the shipowner. Dispute resolution in  international private maritime law.
