Learning outcomes of course unit

Memorisation:

norms and principles of international (maritime) labour law on labour protection and employment in maritime transport;

sources of international and national legal regulation of labour and related relations in the social and labour sphere of seafarers;

structure and principles of the system of supervision and control over compliance with international standards on labour protection and employment in maritime transport.

Understanding:

 the concept of "seafarer" as a special element in the field of social and labour relations in maritime transport;

the functions of international organisations in ensuring seafarers have decent working conditions;

peculiarities of the collective agreement and seafarers' labour contract in ensuring the observance of seafarers' rights to labour protection and employment;

 requirements of national legislation on labour protection and employment in maritime transport;

terms and conditions of recruitment and employment of seafarers and their difference from employment of workers in other professions;

limits of responsibility of the competent state authorities, shipowner and ship officers with regard to labour protection and employment conditions in maritime transport.

Application of knowledge (skills):

resolution of legal cases related to the settlement of labour relations arising in the field of labour protection and employment in maritime transport;

representation of interests of shipowners and seafarers' recruitment and employment services in courts and state authorities;

conducting business activities related to mediation in the employment of seafarers on the vessels of foreign shipowners.

interrelationships of international and national legal regulation of labour protection and employment in maritime transport;

the structure of organisational and legal forms of seafarers' recruitment and employment services to ensure labour protection and employment conditions in maritime transport;

study of effective international experience, practice and regulatory and legal support of shipowners' liability for labour protection and employment in maritime transport.

Assessment:

legal implications of the activities of seafarers' recruitment and employment services, in particular, with regard to seafarers' occupational safety and health and employment conditions in maritime transport;

the effectiveness of the state's exercise of its jurisdiction and control over the activities of seafarers' recruitment and employment services, if any.

Development:

advising interested parties on obtaining a permit (licence) to carry out business activities related to seafarers' employment agency;

Drafting of labour contracts and collective agreements on terms and conditions that ensure labour protection and employment of seafarers in maritime transport;

filing lawsuits, representation of seafarers in court to protect their labour rights, social benefits, leave, payment of wages and remuneration for emergency work on board both Ukrainian and foreign flagged vessels.

International legal protection of seafarers' labour within the framework of specialised UN agencies and international non-governmental organisations. Organisational and legal forms of recruitment and employment services. Requirements of the Ukrainian legislation on the implementation of economic activities in mediation in employment abroad. Procedure and conditions of recruitment and employment of seafarers. Labour protection and employment conditions for seafarers. Collective agreement and seafarer's employment contract. Shipowners' liability insurance. Protection of seafarers in the field of social security. The concept of human factor and its relationship with seafarers' working conditions. Gender equality in global shipping: legal and organisational framework for ensuring. Systems of supervision and control over compliance with international labour standards for seafarers.
